This policy explains how Account Pigeon collects, holds, uses and discloses personal information, and how you can access it, correct it or complain about how we have handled it.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and, in relation to tax file numbers, the Privacy (Tax File Number) Rule 2015. This policy sits alongside our Master Engagement Terms, which form part of your engagement with us.

1. Whose information we handle

We collect personal information about:

  • Clients — individuals we act for, and the directors, trustees, partners, shareholders, beneficiaries and authorised contacts of entities we act for

  • Related individuals — spouses and dependants, where their details affect a client's tax position

  • Employees and contractors of business clients — where we provide payroll or bookkeeping services

  • Visitors to our website and people who contact us through it

  • People who apply to work with us

If you are a business client giving us information about other people — your employees, contractors, beneficiaries or family members — you are responsible for having told them that their information will be given to us, and for directing them to this policy.

2. What we collect

  • Name, date of birth, residential and postal address, email address and telephone number

  • Tax file number, Australian Business Number, and other government identifiers such as driver licence, passport or Medicare details where we are required to verify your identity

  • Income, deduction, asset, liability and banking information, including bank account details for refunds and direct debits

  • Employment, superannuation and payroll information

  • Information about your family and dependants where it affects your entitlements, offsets or trust distributions

  • Records of our dealings with you, including messages sent through your client portal

Sensitive information

Some tax matters require sensitive information — for example private health insurance details, medical expenses, or information about a disability that affects an offset or entitlement. We collect sensitive information only where it is reasonably necessary for the services you have engaged us to provide, and only with your consent.

Tax file numbers

Tax file numbers are subject to specific legal protection. We collect and use your tax file number only for the purpose of your taxation, superannuation or personal assistance affairs. We do not use it as a general identifier, we do not disclose it except as authorised by law, and we take reasonable steps to keep it secure and to destroy it once we are no longer required to retain it.

3. How we collect it

Wherever it is reasonable and practicable, we collect personal information directly from you — through your client portal, our onboarding questionnaire, Schedule A of your engagement, or in conversation with us.

We also collect information from:

  • the Australian Taxation Office, once you have appointed us as your registered tax agent, including prefill data, lodgement history and your integrated client account

  • your employer, superannuation fund, bank or share registry, where you have authorised it

  • your other advisers, such as a solicitor, financial adviser, mortgage broker or previous accountant, where you have authorised it

  • publicly available registers, including ASIC and the Australian Business Register

  • identity verification services, where we are required to verify your identity

If we cannot collect the information we need, we may not be able to provide the services you have asked for, and you may lose the protection described in clause 3.3 of our Master Engagement Terms.

4. Why we collect it and how we use it

  • To prepare and lodge returns, financial statements and activity statements

  • To provide bookkeeping, payroll and advisory services

  • To communicate with the ATO and other agencies on your behalf

  • To verify your identity and meet our customer due diligence obligations

  • To issue invoices and collect fees

  • To meet our obligations as a registered tax agent and as a member of the Institute of Public Accountants

  • To respond to your enquiries and manage our relationship with you

  • To tell you about deadlines, obligations and changes to the law that affect you

5. Who we disclose it to

We disclose to

  • Australian Taxation Office — lodgements, correspondence and agent-linked access to your records

  • Tax Practitioners Board — where required under the Tax Agent Services Act 2009

  • ASIC — company lodgements, where engaged

  • AUSTRAC — where required under anti-money laundering and counter-terrorism financing law

  • Institute of Public Accountants — the IPA Quality Review Program, unless you tell us in writing not to

  • Our professional indemnity insurer and legal advisers — where a claim or potential claim arises

  • Our staff and contractors — to perform the services, under written confidentiality obligations and our supervision

  • Software and service providers — to host, process and store your information, see section 6

  • Anyone you authorise — for the purpose you authorise

We do not sell personal information, and we do not disclose it to third parties for their own marketing purposes.

We may also be required by law to disclose information, and in some circumstances we may be prohibited from telling you that we have done so.

6. Overseas disclosure and the providers we use

Some of your information is accessed or stored outside Australia.

  • Our bookkeeping personnel — Vietnam. Bookkeeping, payroll processing and account reconciliation, through our systems.

  • Xero — Amazon Web Services, United States. Accounting, payroll and tax software.

  • Client Hub — United States. Client portal, messaging and document storage.

  • Google Drive — United States. Email and file storage.

  • Squarespace — United States. This website and any form you submit through it.

  • VerifyAU — Australia. Verifying your identity.

We take reasonable steps to ensure that recipients outside Australia handle your information consistently with the Australian Privacy Principles, including through written confidentiality and data handling obligations, restricted access to our systems, and a prohibition on storing your information locally on their own devices.

You acknowledge that we may not be able to ensure that an overseas recipient does not breach the Australian Privacy Principles, and that such a recipient may not be subject to the Privacy Act 1988 (Cth). Accepting our engagement terms is your consent to these disclosures. If you do not consent, tell us before accepting the engagement and we will discuss alternatives, which may affect our fee.

We will tell you before we engage a new provider that changes this position.

7. How we keep it secure

We hold your information in electronic form in the systems listed above. We protect it using access controls, multi-factor authentication, encryption in transit, restricted permissions for staff and contractors, and written confidentiality agreements.

All documents and instructions must be sent through your client portal. We cannot act on instructions sent by SMS, WhatsApp or social media, and we ask that you do not send tax file numbers or identity documents by email.

No system is completely secure. If a data breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.

8. How long we keep it

We retain client records for at least five years, consistent with taxation law and clause 13 of our Master Engagement Terms. Identity verification records are retained for [7] years as required by anti-money laundering law. We may retain information for longer where a legal obligation, claim or investigation requires it.

When we no longer need information and are not required to keep it, we destroy it or de-identify it.

9. Marketing

We may send you emails about deadlines, obligations, changes to the law and our services. Every one of those emails contains an unsubscribe link, and you can also ask us to stop at any time by writing to us at the address below. Unsubscribing does not stop the messages we must send you about your engagement.

10. Our website

Our website is hosted by Squarespace. When you visit, Squarespace collects standard analytics information including your IP address, device and browser type, the pages you visit and the site you came from, using cookies and similar technologies. This helps us understand how the site is used.

You can block or delete cookies in your browser settings, though parts of the site may not work as intended. If you submit a form or make an enquiry through the site, we collect the information you give us and use it to respond.

11. Accessing and correcting your information

You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it is wrong, out of date or incomplete. Write to us at the address below. We will respond within 30 days.

We do not charge for making a request. We may charge a reasonable cost for retrieving and providing extensive records, and we will tell you the cost before we do the work.

There are limited circumstances in which we may refuse access — for example where it would unreasonably affect another person's privacy, or where the information is subject to legal professional privilege. If we refuse, we will tell you why in writing and explain how to complain.

Note that our working papers and internal file notes remain our property under clause 12 of our Master Engagement Terms, though your right to access personal information within them is unaffected.

12. Complaints

If you think we have mishandled your personal information, contact us first at admin@accountpigeon.com.au. Tell us what happened and what you would like us to do. We will acknowledge your complaint within 5 business days and respond within 30 days.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

Complaints about our professional conduct as a registered tax agent go to the Tax Practitioners Board at tpb.gov.au.

13. Changes to this policy

We may update this policy. The current version is always the one published on this page, and the effective date is shown at the top. Where a change materially affects how we handle your information, we will tell you.
